Independent Artists Appeal to President Obama and Elected Officials to Abolish Summary Judgment

Atlanta’s Own Dallas Austin and “Drumline” among Multiple Works Allegedly Stolen from Independent Artists ”˜in the Name of the Law’

ATLANTA, Ga. — This week, the producers of the soon-to-be-released documentary, “Injustice for All: Summary misJudgment” and several independent artists are appealing to President Barack Obama and other elected officials to abolish Rule (56) (c) Summary Judgment Motions. The motions have been used repeatedly to dismiss several copyright infringement cases brought by independent artists against major production companies, including the case of Darryl Lassiter vs. Dallas Austin and 20th Century Fox.

Lassiter alleges that the film “Drumline” was based on his script, “Pay the Price.” He also alleges that Austin continues to profit from the film’s concept with the release of a recent documentary project and “Drumline Live,” a musical production to be performed later today at the Cobb Galleria.

“After conducting an in-depth interview with Mr. Lassiter, and reviewing copies of all of the court records surrounding this case, which include the Independent expert's detailed analysis, I believe that his case, was thrown out of court illegally,” said Carla Boone, record label owner and documentary producer. “We will continue to fight for the abolishment of Summary Judgment Motions as all independent artists have the right to have their cases tried before an unbiased jury of their peers.”

In Boone’s letter to President Obama and members of Congress, she states that, “When the very people that are charged with protecting us are doing just the opposite, it is more than depressing. It is disheartening”¦President Obama, please help us get the Justice we deserve.” The letter follows on the heels of another appeal sent to elected officials by independent artists featured in Boone’s documentary, all of which had their cases dismissed under the Summary Judgment Motion.

Well-known works at the center of the cases discussed in the documentary include the films “Drumline” and “Life,” the popular animated series “SpongeBob Square Pants,” the video game Psi-Ops: The Mind Gate Conspiracy and the song Young’N (Holla back) recorded by Fabulous and produced by The Neptunes. The documentary chronicles how the artists’ works were created, developed, marketed and allegedly stolen, features independent experts who analyzed the works and examines how the courts ignored their testimonies.

Summary Judgment is a practice that has been documented by scholars Professor Suja A. Thomas and Joel Bronsteen to be illegal as it violates the 7th Amendment right to a jury trial. Therefore, in addition to calling for the abolishment of Summary Judgment Motions, the producers of “Injustice for All: Summary misJudgment” and independent artists across the U.S. are also calling for the immediate convening of an independent panel to reinstate or rehear and all cases thrown out by subjective rulings of these judgments within the past 10 years.

“The theft of independent artists’ life work are is clearly unjust and will no longer be tolerated by the creative community,” said Boone. “We are reaching out to our representatives on Capitol Hill to help us usher in a new era where Hollywood gatekeepers are held accountable and independent artists are fairly acknowledged and compensated for their work.”

District Court dismisses case, denying Boone right to have case heard by jury.

Numerous legal errors made by District Court Judge (and subsequently admitted by Court of Appeals).

Attornies file for sanctions (asking that Boone pay all their attorney fees) for filing frivoulous case. Sanctions were denied by the District Court stating that there was reasonable basis for Boone's counsel to believe that her allegations were "grounded in fact "when complaint was filed.
Throughout proceedings Defendants claim they have never heard of us!
